Special ACD Regulatory Virtual Training Session: Toxics Release Inventory Reporting

A Step-by-Step Guide to Calculating Annual Releases and Filing Accurate Reports

The July 1, 2022, deadline to file Toxic Release Inventory (TRI) reports to the U.S. Environmental Protection Agency (EPA) for calendar year 2021 releases is approaching quickly. To prepare, please join ACD for a special online session to train chemical distributors on how to calculate and document releases and file accurate reports.

Chemical distributors face unique challenges in TRI reporting, making it easy to overreport or underreport annual releases. Both situations should be avoided. Overreporting can make your facility appear in the eyes of the EPA and your community to be a bigger polluter than it is. Underreporting or failure to report can result in substantial EPA penalties.

During this special online training session, Peter F. Downing, CHMM, President of Environment & Safety Solutions, will teach participants how to calculate releases accurately and document them for these annual EPA reports. Attendees will receive a workbook that includes a step-by-step guide on TRI reporting. Pete will walk participants through this workbook and will discuss common pitfalls chemical distributors face when reporting and how to avoid them. Participants will leave this training session with the tools needed to complete and file 2021 TRI reports accurately.

Contracts for Chemical Distributors

Patrick Hughes and Steve Barnett of Connell Foley LLP presented on the types of contracts a typical chemical distributor might encounter including supply, purchase, toll manufacturing, licensing, R&D, and asset sales. They covered boilerplate provisions, remedies and breach of contract, as well as force majeure or excused non-performance, impracticability, allocation and other provisions that may be applicable during the COVID-19 pandemic.
